Terms of Use

These terms apply when you use Barnstable Residents Directory. By continuing to use the service, you accept them. Do not use the service if you do not agree.

1. Nature of This Service

Barnstable Residents Directory is a private reference service. It describes and links to public-record indexes, rolls, and directory collections relevant to Barnstable, Massachusetts. It does not host government records and is not affiliated with an office, court, library, or custodian.

2. Lawful Use Rules

Use the service only for lawful purposes. You may not use it, or information reached through it, to:

  • Stalk, harass, intimidate, threaten, or harm any person
  • Locate someone protected by a restraining or protective order
  • Commit identity theft or fraud
  • Make FCRA-regulated decisions (credit, employment, tenant, insurance)
  • Scrape, copy, or republish the site's content at scale
  • Interfere with the site's operation or security

3. No Consumer-Reporting Role

This service is not a consumer reporting agency under the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. Nothing provided here, or returned by a linked search tool, is a consumer report. It may not be used to decide eligibility for credit, employment, housing, insurance, or another FCRA-regulated purpose.

4. Third-Party Services

Government portals and outside services, including sponsored search tools, maintain their own terms and policies. We do not control their content, availability, pricing, or data practices.

5. No Warranties

The service is offered "as is" and "as available" without warranties. We do not promise that material is accurate, complete, or current, or that any linked portal will be available or return correct results.

6. Limits of Liability

To the fullest extent allowed by law, we are not liable for direct, indirect, incidental, consequential, or special damages arising from use of this service or a linked resource, including decisions based on a record reached through it.

7. Indemnification

You agree to indemnify and hold harmless the service operators from claims or demands, including reasonable attorneys' fees, that arise from misuse of the service or a violation of these terms.

8. Intellectual Property

The original text, design, logo, and layout are protected by copyright. Links and brief attributed quotations are permitted, but republishing complete pages or systematically copying content is not.

9. Changes to These Terms

We may revise these terms by posting an updated version here. Continued use after a revision means you accept it.

10. Access Restrictions

We may limit or block access without notice when a user violates these terms or abuses the service.

11. Governing Law

Massachusetts law governs these terms without regard to conflict-of-law principles. Massachusetts Public Records Law, MGL c.66 §10 and the exemptions in MGL c.4 §7, govern public-record access through government custodians; they do not make this private service a custodian.

12. Severability

If a part of these terms is unenforceable, the remaining provisions continue in effect.

13. Questions
